1. Agreement to Terms

By scheduling, booking, or using any services provided by On Time Pool Services & Solutions, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

2. Services Provided

On Time Pool Services & Solutions offers the following professional pool services:

• Pool Cleaning: Regular and one-time cleaning services including debris removal, surface skimming, vacuuming, brushing, and water testing
• Pool Repairs: Diagnostic services, equipment repairs, leak detection, pump and filter repairs, heater services, and emergency repairs
• Pool Installation: New pool construction consultation, equipment installation, and system setup
• Pool Maintenance: Regular maintenance programs, chemical balancing, equipment inspection, and preventive care

All services are provided by qualified and experienced technicians in accordance with industry standards and local regulations.

3. Scheduling and Appointments

3.1 Booking: Services can be scheduled through our website, phone, email, or WhatsApp. We will confirm your appointment within 24 hours of your request.

3.2 Cancellations: If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee.

3.3 Access: You must provide clear access to your pool and any relevant equipment at the scheduled service time. If our technicians cannot access the pool area, a trip charge may apply.

3.4 Service Windows: We provide service windows and will make every effort to arrive within the scheduled time. Delays may occur due to unforeseen circumstances, and we will notify you as soon as possible.

4. Pricing and Payment

4.1 Quotes: All pricing is customized based on your specific pool needs, size, and service requirements. Written quotes are provided upon request and are valid for 30 days unless otherwise stated.

4.2 Payment Terms: Payment is due upon completion of service unless alternative arrangements have been made in writing. We accept cash, credit cards, bank transfers, and mobile payments.

4.3 Maintenance Plans: For recurring maintenance services, payment is due monthly in advance. Plans can be canceled with 30 days' written notice.

4.4 Additional Work: If additional repairs or services are identified during a scheduled visit, we will provide an estimate and obtain your approval before proceeding with any work beyond the original scope.

4.5 Late Payments: Accounts not paid within 30 days may be subject to a late fee and suspension of services until the account is brought current.

5. Warranties and Guarantees

5.1 Service Guarantee: We stand behind our work. If you are not satisfied with our service, please contact us within 48 hours, and we will return to address any concerns at no additional charge.

5.2 Repair Warranty: All repair work is guaranteed for 90 days from the date of service, covering both parts and labor for the specific repair performed.

5.3 Parts and Equipment: Manufacturer warranties apply to all new parts and equipment installed. We will assist with warranty claims as needed.

5.4 Exclusions: Our warranty does not cover damage caused by misuse, neglect, acts of nature, or modifications made by others after our service.

6. Limitation of Liability

6.1 Service Limitations: While we take every precaution to provide quality service, On Time Pool Services & Solutions shall not be liable for:

• Pre-existing conditions or hidden defects not discoverable through reasonable inspection
• Damage to pool surfaces, equipment, or property caused by factors beyond our control
• Delays or inability to perform services due to weather, equipment availability, or other circumstances beyond our reasonable control
• Consequential or indirect damages arising from service delays or equipment failures

6.2 Maximum Liability: Our total liability for any claim related to our services shall not exceed the amount paid for the specific service giving rise to the claim.

6.3 Insurance: We maintain appropriate liability insurance and workers' compensation coverage for our business operations.

7. Customer Responsibilities

As a customer, you agree to:

• Provide accurate information about your pool, equipment, and any known issues
• Ensure safe and unobstructed access to the pool area and equipment
• Secure pets during service visits
• Inform us of any special conditions, hazards, or concerns before service begins
• Follow any maintenance recommendations provided by our technicians
• Maintain appropriate water levels in your pool
• Notify us immediately of any problems or concerns with services provided

8. Emergency Services

8.1 Availability: Emergency repair services are available 24/7 for urgent situations such as major leaks, equipment failures, or safety hazards.

8.2 Emergency Rates: Emergency service rates apply to after-hours, weekend, and holiday calls, which will be disclosed at the time of booking.

8.3 Response Time: We will make every effort to respond to emergency calls as quickly as possible, typically within 2-4 hours depending on location and circumstances.

9. Privacy and Confidentiality

We respect your privacy and handle your personal information in accordance with our Privacy Policy. We collect and use your information solely for the purpose of providing services, communicating with you, and improving our business operations. We do not sell or share your personal information with third parties except as necessary to provide our services or as required by law.

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of On Time Pool Services & Solutions and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

11. Dispute Resolution

11.1 Communication First: If you have any concerns or disputes regarding our services, please contact us directly. We are committed to resolving issues promptly and fairly.

11.2 Mediation: If we cannot resolve a dispute through direct communication, both parties agree to attempt mediation before pursuing legal action.

11.3 Governing Law: These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to conflict of law principles.

12. Termination of Service

12.1 By Customer: You may terminate recurring services at any time with 30 days' written notice. Early termination of contracted services may be subject to fees as outlined in your service agreement.

12.2 By Company: We reserve the right to terminate service for non-payment, unsafe conditions, abusive behavior toward our staff, or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these Terms periodically.

14. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice. We will make every effort to minimize disruption to existing customers.

15. Entire Agreement

These Terms, along with any written service agreements, quotes, and our Privacy Policy, constitute the entire agreement between you and On Time Pool Services & Solutions regarding our services and supersede all prior agreements and understandings.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
